Isteri saman syarikat insurans RM2 juta

PULAU PINANG 25 April - Seorang wanita yang kematian suami akibat kanser paru-paru hari ini memfailkan saman terhadap sebuah syarikat insurans yang didakwa enggan membayar sebarang pampasan kepadanya atas alasan tidak memenuhi faedah perubatan.

Ooi Cheng Cheng, 43, berkata, suaminya, Wilson Tan Teck Hooi atas pujukan wakil syarikat AXA Affin General Insurance Bhd. yang beralamat di Jalan Raja Chulan, Kuala Lumpur membeli polisi insurans syarikat berkenaan yang dinamakan Cancer Plus Plan pada 1 November 2012.

Menurut pernyataan tuntutan yang difailkan oleh Cheng Cheng selaku plaintif di Mahkamah Tinggi di sini hari ini, ketika suaminya membeli polisi insurans itu, dia didakwa tidak dimaklumkan tentang sebarang syarat selain syarikat terbabit tidak meminta laporan pemeriksaan kesihatan.

Sementara itu, peguam Jason Ong Khan Lee yang mewakili plaintif berkata, Wilson yang juga seorang pengurus kilang meninggal dunia akibat kanser tahun lalu dan isterinya menuntut ganti rugi RM2 juta kerana syarikat berkenaan gagal membuat bayaran walaupun telah diserahkan dokumen prognosis.

"Klausa 2 pada polisi berkenaan memperuntuk syarikat tersebut akan membayar pampasan berdasarkan pelan polisi yang telah dibeli sekali gus sekiranya disahkan menghidap penyakit berkenaan dengan nilai mencecah RM150,000, "katanya kepada pemberita.

Jason berkata, Klausa 3 insurans berkenaan pula memperuntuk premium bulanan yang harus dibayar si mati ialah sebanyak RM55.30 dan Klausa 5 pula memperuntuk masa sehingga 90 hari.

Menurutnya, selaras dengan Klausa 3 polisi insurans berkenaan, Wilson ketika masih hidup telah membuat bayaran premium bulanan sehingga bulan kematiannya.

"Malangnya beliau telah meninggal dunia pada 14 April 2013 dan pada 20 Januari lalu, plaintif telah menelefon syarikat terbabit untuk membuat tuntutan tetapi dimaklumkan tuntutan berkenaan ditolak kerana tidak memenuhi syarat," katanya.

Sehubungan itu, plaintif menuntut ganti rugi RM2 juta atau satu jumlah yang dianggap sesuai oleh mahkamah termasuk ganti rugi teruk dan ganti rugi teladan.

insuran nak yang sihat walafiat aje...kalau yang sakit dia tak terima,kalu terima pun bayar free aje lah bukan boleh claim pun sebab dah termaktub dalam agreement semasa ambil insuran mesti bebas penyakit....pi mai pi mai tang tu juga...yang untung insuran,hu2

ni kantoi maybe related ngan pre existing condition la kut ni.. so, sebelum beli kalau ada sakit apa2 tu, declare la dalam proposal form.. kalau tak declare, kena pandai2 la... bukan apa.. kalau insurance investigate then dpt tahu ada pre existing condition, esp illness related to Diabetes, hypertension etc, mmg sakit la.. kalau kes kat atas, even kalau illness tu takde kena mengena ngan cancer for example, & 100% tak declare, any claim yg ada b4 reunderwrite mmg tak bayar..  aku explain from insurance co. point of view sbb haku bukan agt... once dah turunkan tandatangan kat proposal form yg kata dah declare everything tu, tiba2 info tak betoi korang ingat leh menang ker...

So far insurance aku senang claim..... 2x hospitalize tak sampai 2 bln claim dh dpt cheque.....

Insurans masa nak jual...mulut bukan main manis...bila kita cakap dah ada...siap pujuk lagi suruh beli lagi satu walhal konsepnya bila berlaku keclakaan hanya satu tuntutan je bole dibuat....

Pre-existing condition kot ni. X declare masa beli insurance. So far based on my experience, kalu menepati syarat2, tak de sebab insurance company tak nak bayar.

Tak paham aku kes ni....dah lepas tempoh 4 bulan ke belum masa detect cancer tu. Kalau belum 4 blm, memang wassalam.aku guna prudential. Hari tu hospitalised ngam ngam cukup 4bln so boleh claim elaun harian

Masa janji mulut manis semua.. N ada org plak jenis xbaca semua..lepas dah sakit baru tahuitu xboleh..ini xboleh...

Me dah brpa kali dorg call offer mcm2.. Last yg call offer utk kanser..

Mula dia buka mulut me jawab.sori sy xberminat... Dia kt sy belum hbis ckp mcm mn puan ckp xminat. I said fyi dah berpuluh org cal me offer insuran but  ok.. Ckp... Then dia igt dia dah menang so bla3...kalu disahkn kanser dapt 30 000 ke bape ntah.then i jawab.. Wow sakit skrg pon dapat duit ek..untung kalu berpenyakit.. Dia pon jwblah eh xdelah xminta tp bla3 sambung lg ceramh sebut la tmbh 10k aper ntah.. Then me ckp..ok da? Sori i xberminat..
Masoh lg xputus asa dia tanya plak lg.. Knpa puan xberminat.. Ini boleh dpt 30k kalu pn disahkn ada knser bla3.. Puan ada amik insuran?  I jawab ada.. Its ok i dah ada..
Pastu tanya lg.. Insuran apa? I jawab..knp u nk tau? I dah ckp ader kn? Compny hb dah ada cover semua..

AXA Affin General Insurance Berhad (AXA Affin) does not pay for claims related to:

any cancer and/or carcinoma-in-situ directly or indirectly caused by any pre-existing condition; cancer for which the insured person gets medical advice, has symptoms, or tests, or received any medication or treatment within 90 days immediately following the commencement date of this policy or from the date such insured person was first covered under this policy; carcinoma-in-situ for which the insured person gets medical advice, has symptoms, or tests, or received any medication or treatment within 120 days immediately following the commencement date of this policy or from the date such insured person was first covered under this policy; cancer and/or carcinoma-in-situ which is diagnosed and the insured person lives for a period of less than fourteen (14) days after the diagnosis; cancer and/or carcinoma-in-situ for which the insured person is claiming if the insured person has been diagnosed with the same cancer and/or carcinoma-in-situ before the commencement of this policy or before the date such insured person was first covered under this policy; cancer and/or carcinoma in situ diagnosed in the presence of Human Immunodeficiency Virus (HIV).

a diagnosis made by a medical practitioner who is an insured person or a member of the insured person's family; cancer and/or carcinoma in situ caused as a result of nuclear contamination, biological contamination or chemical contamination.

AXA Affin will not pay benefits for claims for which AXA Affin has not received a properly completed claim form and original invoices within 90 days of the treatment being given.

AXA Affin will not allow insured persons to upgrade their level of cover except at each policy anniversary and only then when requested, in writing, to do so. Acceptance by us of such an upgrade must be confirmed in writing by us before the upgrade can become effective.

During the first 12 months following the effective date of upgrade, AXA Affin will not pay upgraded benefit levels relating to treatment of any medical condition which arises prior or at the time of the upgrade. Benefits for such a medical condition will be restricted to the level of cover that would have been applicable to such a medical condition prior to the upgrade.

haaa, sebab tu lah kena tanya PENASIHAT TAKAFUL bukan penjual takaful atau telemarketer by phone. So many thing customer kena tahu tentang basic polisi terutama
1/Sum cover atau jumlah perlindungan untuk kematian atau lumpuh kekal samada sama atau xserupa,
2/rider , manfaat atau keistimewaan customer tambahan yang perlu diketahui jika berlaku musibah,
3/loading jika dah ada penyakit
4/ medikal kad, stand alone atau need to combine dengan pelan basic. samada co takaful(customer dan company sama byr pembedahan) atau tiada co takaful(compny bayar penuh), deposit masuk hospital swasta (for sure kena kena call sndri hospital swasta) jgn percaya bulat2.

Kalau nak kata compny insuran takaful untung seratus x kut, sebab BANYAK jer kes orang yang meninggal dunia selepas sebulan, 6bulan dan etc bayar sumbangan bulanan (means baru jer bayar xcukup setahun) dan waris dapat PAMPASAN WANG RINGGIT YANG BANYAK.
