1MDB and the politics of donation and deception
12:53PM Aug 4, 2015
http://www.malaysiakini.com/news/307284
MP SPEAKS The last few weeks we have seen the antics of government, which was one big huge drama with a sloppily-written script.
The culmination however was the outcome of the Malaysian Anti-Corruption Commission (MACC) investigation, which said that the RM 2.6 billion found in Prime Minister Najib Abdul Razak’s private bank account comes from donations.
To me and a large segment of Malaysians, this does not make sense. Why didn't Najib volunteer this information in the first place? Why did he keep mum despite mounting pressure from the rakyat, demanding to know where the huge amount of money had come from? And more importantly, why keep the donations a secret from his former deputy Muhyiddin Yassin, who repeatedly said Najib needs to come clear about the source of the cash.
Before the anti-corruption body revealed its findings, one of its top ranking officers was arrested. Officers in the Attorney-General’s Chambers were arrested. Former attorney-general Abdul Gani Patail (photo) and Muhyiddin were sacked without notice. Four members from the Public Accounts Committee (PAC) were given cabinet positions, halting investigations into 1MDB.
Then Najib’s spin doctors said there is a foreign power-instigated conspiracy to topple the PM and government. And throughout the drama, various government bodies and ruling politicians warned Malaysians against questioning about the 1MDB financial brouhaha or Najib’s role in it.
Therefore can anyone be blamed for questioning if these arbitrary measures were undertaken to help save Najib? Did the MACC sidestep the task force and the PAC to unceremoniously clear the prime minister? Does Najib really believe the people will trust the findings of the anti- graft commission?
Najib and his public relations team have clearly spun a rather complex yarn. But things have changed in Malaysia. And the rakyat are just not buying into their fairy tales any more.

Former Israeli Premier Olmert Convicted in Corruption Case
By THE ASSOCIATED PRESS MARCH 30, 2015, 3:25 A.M. E.D.T.
JERUSALEM — Former Israeli Prime Minister Ehud Olmert was convicted Monday of unlawfully accepting money from a U.S. supporter in a retrial on corruption charges, the latest chapter in the downfall of a man who only years earlier hoped to lead the country to a historic peace agreement with the Palestinians.
The conviction could land Olmert five years in prison, in addition to a six-year prison sentence he received last year in a separate bribery conviction, all but ensuring the former premier will not return to politics for many years to come.
"His behavior constitutes a breach of trust which harms the public, harms morality, and harms the public's trust, in how he behaved corruptly," prosecutor Uri Korev said following the verdict.
Olmert's lawyers said they would likely appeal the ruling by the Jerusalem District Court. A sentencing hearing is slated to take place in May.
Olmert has claimed he was on the brink of a historic agreement with the Palestinians when he was forced to resign in early 2009 amid corruption allegations. His departure cleared the way for hard-liner Benjamin Netanyahu's election, and subsequent peace efforts have not succeeded.
Olmert, 69, was acquitted in 2012 of a series of charges that included accepting cash-stuffed envelopes from U.S. businessman Morris Talansky when Olmert was mayor of Jerusalem and a Cabinet minister. Olmert was found to have received about RM2,311,076.61 ($600,000) from Talansky during his term as mayor, and additional amounts in cash during his term as a Cabinet minister, but a court did not find evidence the money had been used for unlawful personal reasons or illegal campaign financing.
Talansky, an Orthodox Jew from New York's Long Island, had testified the money was spent on expensive cigars, first-class travel and luxury hotels, while insisting he received nothing in return.
The acquittal on the most serious charges at the time was seen as a major victory for Olmert, who denied being corrupt. He was convicted only on a lesser charge of breach of trust for steering job appointments and contracts to clients of a business partner, and it raised hopes for his political comeback.
But Olmert's former office manager and confidant Shula Zaken later became a state's witness, offering diary entries and tape recordings of conversations with Olmert about illicitly receiving cash, leading to a retrial. In the recordings, Olmert is heard telling Zaken not to testify in the first trial so she would not incriminate him.
On Monday, a panel of judges at the Jerusalem District Court ruled that Olmert had accepted RM592,983.74 ($153,950) from Talansky when he was a Cabinet minister, with the money kept hidden in a safe by an Olmert aide.
The judges concluded that Olmert gave Zaken part of that money in exchange for her loyalty, and used the money for his own personal use without reporting it according to law. They convicted him on a serious charge of illicitly receiving money, as well as charges of fraud and breach of trust.
Olmert's lawyer, Eyal Rozovsky, said Olmert's legal team was "of course very disappointed" by the ruling and will likely appeal.
The conviction stoked anger in Israel.
"I want Ehud Olmert to apologize to the people of Israel," said columnist and former Olmert confidant Dan Margalit on Israel Radio Monday.
In a separate trial in March 2014, Olmert was convicted of bribery over a Jerusalem real estate scandal and was sentenced to six years in prison. He appealed and has been allowed to stay out of prison until a verdict is delivered.
Now, the judges must decide whether Olmert should serve additional prison time for Monday's conviction, or whether his six-year sentence is enough of a punishment for both offenses, legal expert Emanuel Gross said.
"It's a very, very serious task that the court is going to face, to punish a (former) prime minister for a crime after the court knows he's been convicted with bribery," Gross said.

Umno must not keep quiet, it’s time to act, says Johor MB

Johor Menteri Besar Datuk Seri Khaled Nordin urges Umno members not to let corruption become a culture, a day after the MACC cleared the prime minister of receiving billions of ringgit of 1MDB money. – The Malaysian Insider file pic, August 4, 2015.
Umno must not allow itself to be used as a party to protect the interests of a "few" under the guise of "loyalty or discipline", the Johor menteri besar said today, becoming the first state Umno chief to react publicly to yesterday's clearance by the anti-graft body over the RM2.6 billion in the prime minister's bank accounts.
In a Facebook posting today, Datuk Seri Khaled Nordin said Umno cannot keep quiet if "corruption becomes a culture or trust is betrayed".
"Umno cannot keep quiet when the party no longer champions the cause of Malays but is instead used to defend a few under the name of loyalty or discipline in adhering to leaders," he wrote.
"Umno can no longer stand by as an observer. The time has come for Umno to move forward, to be more proactive and dominant," he added.
Khaled's remarks come a week after Tan Sri Muhyiddin Yassin was sacked as deputy prime minister for questioning Prime Minister Datuk Seri Najib Razak's handling of debt-ridden 1Malaysia Development Berhad (1MDB).
Khaled was among the first senior party leaders to urge party grassroots to respect Muhyiddin despite his sacking, as he was still Umno deputy president.
Yesterday, the Malaysian Anti Corruption Commission (MACC) confirmed that some RM2.6 billion was transferred to Najib's bank accounts, but said the money was from donors.
Khaled was also present during Muhyiddin's audience with the Johor sultan, Sultan Ibrahim Iskandar, last Sunday. Khaled made the remarks even as other Umno leaders spoke in defence of Najib.
Newly-promoted minister Datuk Seri Azalina Othman had said that the RM2.6 billion in Najib's accounts was not a big issue.
After the MACC's announcement last night, Barisan Nasional (BN) strategic communications director, Datuk Abdul Rahman Dahlan, tweeted that "many on Twitter were hoodwinked" by those who said that the prime minister had stolen from 1MDB and the people, referring to The Wall Street Journal (WSJ) which first reported the allegation, website Sarawak Report and opposition politicians.
Today, Umno Youth chief Khairy Jamaluddin said it was not a crime for Najib to receive political donations and hold them in trust for Umno. – August 4, 2015. -

Jangan jadikan rasuah budaya parti, kata Umno Johor

Menteri Besar Johor Datuk Seri Mohamed Khaled Nordin menulis di Facebooknya mengenai ahli Umno tidak seharusnya pertahan golongan tertentu atas nama taat setia. – Gambar The Malaysian Insider, 4 Ogos, 2015.

RM2.6 billion in Najib’s account not a crime, says Khairy
Published: 4 August 2015 12:49 PM

Youth and Sports Minister Khairy Jamaluddin believes Prime Minister Datuk Seri Najib Razak did not commit any crime by accepting the RM2.6 billion in political donations. – The Malaysian Insider file pic, August 4, 2015.
Prime Minister Datuk Seri Najib Razak did not commit any crime by accepting the RM2.6 billion in political donations on behalf of Umno, says Youth and Sports Minister Khairy Jamaluddin.
Speaking to news portal Malaysiakini, Khairy said there was no law in Malaysia that prohibited political parties from receiving contributions from supporters.
"In Malaysia, there's no law to prohibit political parties from receiving contributions from supporters," Khairy was quoted as saying.
Yesterday, the Malaysian Anti Corruption Commission (MACC) announced that no funds from state investor 1Malaysia Development Bhd (1MDB) had been put into Datuk Seri Najib Razak's accounts at AmBank, saying the US$700 million (RM2.6 billion) had come from donors instead.
Allegations of RM2.6 billion in Najib's accounts first surfaced in a report by The Wall Street Journal (WSJ) on July 2, citing documents from Malaysian investigators.
The WSJ said the source of the funds were unknown, but had flown through 1MDB-linked entities in various tranches, the largest of which – US$681 million – was channelled to Najib's accounts in March 2013, ahead of the general election in May that year.
MACC yesterday said it had been investigating the allegation in addition to another probe into the Finance Ministry-owned SRC International Sdn Bhd, the 1MDB subsidiary which took a RM4 billion loan from government pension fund Retirement Fund Incorporated.
Najib denied taking 1MDB funds for personal use, but had not directly addressed the fund transfers.
The Umno Youth chief told the news portal that political donations were practised by politicians regardless of their parties.
"Not only Umno and BN, every politician receive donations from their supporters to help them in political work. I am sure all the parties get contributions from friends and supporters," he was quoted as saying in the report.
Khairy also said whether the donations were put into personal or party accounts varied as long as it was held in trust by the personal account holder for the party. – August 4, 2015.
