4 possible outcomes when ICJ delivers decision on Pedra Branca on Friday

SINGAPORE: The longstanding dispute between Singapore and Malaysia over Pedra Branca, known in Malaysia as Pulau Batu Puteh, will have closure this Friday.

The International Court of Justice (ICJ) will deliver its decision on which country has sovereignty over the island and its rocky outcrops, Middle Rocks and South Ledge.

The dispute arose when Malaysia published its new map in 1979 of its territories, which included Pedra Branca. Singapore disagreed with it because it said it owns the island.

Pedra Branca has remained a thorn in bilateral ties. In 1993, the prime ministers of Singapore and Malaysia decided to refer the case to the International Court of Justice. After three rounds of written pleadings, both sides presented their cases in open court last November.

According to Singapore's Agent to the Court, Professor Tommy Koh, four possible outcomes are likely on Friday.

First outcome: Singapore is awarded sovereignty over Pedra Branca, Middle Rocks and Southern Ledge.

Second outcome: Malaysia is awarded sovereignty over Pedra Branca, Middle Rocks and Southern Ledge.

Third outcome: A split decision, which means that Singapore gets Pedra Branca, the most important feature, while Malaysia gets Middle Rocks and South Ledge.

Fourth outcome: Another split decision, but this time Malaysia gets Pedra Branca, and Singapore gets Middle Rocks and South Ledge.

If full sovereignty goes to Singapore, it will be primarily a maintaining of the status quo, according to Professor Koh.

If full sovereignty goes to Malaysia, there will definitely be a change, though it was argued that this would be a win-win situation as it would continue to allow Singapore to maintain the lighthouse.

Professor Koh said: "We no longer have the right to protect the island through our Navy and Marine Police. So although we may still be the lighthouse operator, the security of the island falls on Malaysia."

No matter what the outcome, both sides have said they will accept and abide by ICJ's decision and that it will not have an adverse impact on bilateral ties.

And as for the Singapore team's outlook, Professor Koh said: "Being a natural born optimist, I am optimistic, but I am not arrogant or presumptuous because the court could decide in any one of the four ways.

"I hope no matter what the outcome is - that both sides will take inspiration from this process and will see this as a possible precedent which could be used to settle bilateral disputes."

A joint committee from both countries will meet after the judgement to work out how to implement the final decision.

A DOCTOR had sex with a clinic assistant in his consultant room after the clinic closed in December 2006, unaware they were being watched by a spy camera.

Dr Tam Tak Chuen was shocked to find pictures of the sex tryst shown by his partners, Dr Khairul Abdul Rahman and Dr Ashraff Shamsuddin Eilyass, at a business meeting on March 4 2006.

Dr Khairul insisted on ending the partnership. Dr Tam claimed he was 'blackmailed' into selling him his share of the business for $50,000.He made a police two days later but investigations were discontinued in August last year.

He is suing Dr Khairul, 44, and another doctor to get the agreement declared null and void.

Dr Tam and Dr Khairul are equal partners of the Eden Family Clinic and one-third partners of Eden Medical Aesthetics in Kembangan with Dr Ashraff.

The businesses are worth more than $2 million and Dr Tam was earning about $250,000 a year. He took up the civil action after the futile police report.

Dr Tam said in court on Tuesday that his affair with Ms Joanne Chew, 25, started when she joined Eden Family Clinic in Jurong West, in 2004.

When it came to his turn to testify on Wednesday, Dr Tam said that on the evening of May 4, Dr Khairul gave him two options:

* Sell his shares in the companies to Dr Khairul for $500,000 and resign as director from the companies;

* Buy Dr Khairul's share for an undisclosed sum, after which Dr Khairul would resign his directorships

If he rejected these options, Dr Khairul threatened to wind up the companies and make public the photographs by disclosing them in the proceedings, Dr Tam said.

A MARRIED doctor who had an affair with his clinic assistant was shocked when his partner installed a spy camera and caught him having sex with the woman.

Now, Dr Tam Tak Chuen, 39, is claiming in a civil suit that he was blackmailed into selling his share of the business for $50,000.

He says he gave in to pressure to sell, fearing that the affair would be exposed and the film of his tryst would land on the YouTube video-sharing website.

He wants the High Court to declare the deal null and void, and wants to get back his share.
He was in business with two doctors, Dr Khairul Abdul Rahman and Dr Ashraff Shamsuddin Eilyaas.

Dr Ashraff settled with Dr Tam when the hearing began before Justice Judith Prakash on Monday. But Dr Khairul is denying that there was any pressure on Dr Tam to sell his stake.

Dr Tam and Dr Khairul were equal partners of the Eden Family Clinic in Jurong West and one-third partners of Eden Medical Aesthetics in Kembangan together with Dr Ashraff.
The businesses were worth more than $2 million, and Dr Tam was earning about $250,000 a year.

Dr Tam said the woman started working at the clinic in 1999 and their affair started sometime in 2004.
It was at a partners' meeting on March 4 last year that everything changed.

Dr Tam said that Dr Khairul, who had had the spy camera installed in the clinic, whipped out photographs showing him having sex with the woman.

He said that he was given a choice of either selling his share in the Eden Family Clinic, or buying out Dr Khairul.
He offered to buy Dr Khairul's share for $50,000 but, he said, he was told he was in no position to negotiate.

Dr Khairul did not want them both to sell to a third party, and threatened to apply to wind up the companies and expose the photographs of Dr Tam with the clinic assistant, Dr Tam said on Monday.

'I was very afraid as I wanted to save my marriage and reputation by not having the pictures and video out there in public or on YouTube,' he said.

Another shock awaited him when he got home that day.

He discovered that Dr Khairul's wife had gone to his home, told his wife about his affair and shown her the photographs.
He said he felt completely betrayed as his partners had promised to keep the matter under wraps.
Fortunately, he said, his wife forgave him.

He made a police report saying he was being blackmailed. The police took the pictures and video recording, but dropped their investigations last August.

Dr Tam denied that the clinic assistant had been his patient. He said she would consult him about minor ailments and he treated her without charge, like all other staff members.

When it was his turn on the stand yesterday, Dr Khairul said that he installed the spy camera when he got tired of Dr Tam denying the affair and wanted to get to the truth.
Once he had the proof, he wanted Dr Tam out of the partnership.

He believed that the affair began as early as 2000, and added that some staff members said they had seen Dr Tam and the woman heading to the clinic's second floor near closing time, when it had no patients.

Dr Khairul said he had found stains on a mattress he kept on the second floor for naps during his breaks.

He said that he had confronted Dr Tam with his suspicions, but the latter denied it every time.
It was only after the spy camera caught him in the act that he finally came clean, Dr Khairul said.

Dr Tam is being represented by Mr Ang Cheng Hock of Allen & Gledhill, while Mr Harish Kumar of Rajah & Tann is acting for Dr Khairul.
The hearing continues.

Passport collection is a breeze now - if you go online

THE collection of passports is a breeze now for those who go online.

All they need do is to make an e-Appointment with the Immigration and Checkpoints Authority (ICA). And then pick up their passports in under 30 minutes on the day of collection.

This is a breeze compared to walk-ins to the ICA building in Lavender, who have to wait for as long as 1 1/2 hours and queue behind as many as 400 people before they get their passports.

Some 4,400 people have used the online collection service since it started this month, said ICA spokesman Lim Jing Jing on Wednesday.

However, with up to 1,700 people flooding the ICA building daily to collect their passports, the ICA wants to improve the present 16 per cent take-up rate.

AT THE end of a five-hour- long pageant, foreign exchange broker Shenise Wong was crowned Miss Singapore Universe 2008 last night.

Recent graduate Malvina Kang, 21, emerged first runner-up while 26-year-old teacher Gayatri Shunmugam, took third place.

The event was held at the Singapore Marriott Hotel, and featured 16 finalists who paraded in evening gowns and swimwear in front of about 330 people.

The audience had paid between $2,000 and $5,000 for each of the 33 tables in the Grand Ballroom of the hotel.

The 1.73m-tall Ms Wong, 26, won $5,000 cash, a trophy and products and services from the sponsors. She will represent Singapore in the international finals in Vietnam in July.

She said: 'I'm definitely very glad to win the Miss Singapore Universe title, it's like a dream come true. I've been wanting this since I was young.'

Unlike in previous years, the pageant was not shown on television. This year's contest also saw a drop in sponsorship and prizes for the winners.

But last night, Ms Wong was not letting any of that spoil her big win.

In the question-and-answer section of the competition, she was asked what animal she would like to be.

She said she would like to be a dog, adding: 'A dog is loyal and intelligent and, as everyone knows, man's best friend.'

Blogger arrested for posting racist online content


He claims that he wrote it only for friends and will apologise online
A LOCAL blogger who ranted about a commuter's behaviour on an MRT train was arrested on Tuesday night.

Police said the 24-year-old Chinese man was taken from his home at Paya Lebar Way at about 9.45 pm for 'posting contents in his blog which may wound the racial feelings of another person'.

A computer, believed to be used to post the suspect's blog, was seized for investigations, which are ongoing.

The case came to the attention of police on May 19 when they received two reports complaining of the alleged posts by the suspect.

According to a report in The New Paper on Wednesday, the blog was apparently sparked off by the suspect seeing a man of an another race sitting on the floor of an MRT train.

The blogger, an undergraduate, allegedly wrote: 'There he sat, unaffected by his surroundings, smelling like he didn't showered (sic) in years and wore some really scary dirty clothes...'

He went on to make other offensive comments about that racial group in his tirade, drawing flak from local netizens, who called him a racist.

One net-user wrote: 'Stupidity has nothing to do with race at all. Just look to that blogger for proof that stupidity transcends all races.'

Added another: 'Some things, once said, cannot be retraced. Don't even make such stupid remarks in the first place.'

Under Section 298 of the Penal Code, Chapter 224, anyone with deliberate intention of wounding the religious or racial feelings of any person, causes any matter however represented to be seen or heard by that person, can be jailed up to three years, or fine, or both, if convicted.

Deputy Commander of Central Police Div HQ, Superintendent Lee Ping Yue, in a statement late on Tuesday, said that police take a serious view of such irresponsible blog postings in a multi-racial society like Singapore and 'will expend all efforts in tracking the perpetrators'.

Interviewed by TNP earlier on Tuesday before his arrest, the blogger said he was sorry for what he had written and would be more mindful of what he says in his blog in future.

He said he was shocked by the furore over his blog entry, which he said was only intended for his close friends. He added that he was surprised that the entry, which was written two months ago, started circulating only days ago.

'I am a very expressive person - my style of writing is over the top. I write this way to make my entries more punchy and exciting,' he told TNP.

He denied being a racist and maintained that he did not harbour any ill will towards the racial group he wrote about.

But he let on that he was in a particularly bad mood the day he wrote the blog entry.

'I meant what I wrote in a different way. If people read it in another way, there is nothing much I can do,' he said, adding that he planned to put up an online apology for his comments.

He has removed the post and password-protected his blog, which was featured on blog aggregator Tomorrow.sg, and linked to several popular online forums.

Two jailed for selling sex enhancement drugs

TWO men were each jailed for 28 weeks on Wednesday for selling illegal health products and other medicines.

Teo See Bong, 57, an odd-job worker, pleaded guilty to five charges while Ong Nguk, 60, unemployed, admitted to six counts under the Medicines Act.

The duo were arrested by a team of police and Health Sciences Authority (HSA) officers, while manning makeshift stalls in the back lane of Desker Road and Rowell Road on Feb 13.

They had various kinds of medicines containing controlled substances for sale.

HSA prosecutor Ngoo Chih Min, who asked for a deterrent sentence, said between Jan 29 and May 16, 40 men had fallen seriously ill after taking adulterated products touted for sexual enhancement such as Power 1.

Together with another 87 suspected cases, all 127 patients had very low blood sugar.

Seven of them slipped into a coma, and four have died.

The pair could have been fined up to $5,000 and/or jailed for up to two years on each charge.

Both had three to four other similar charges considered during their sentencing.

PUB plans to spend S$2b in water treatment and infrastructure projects

SINGAPORE: Singapore's national water agency, PUB, is planning to spend S$2 billion in water treatment and infrastructure projects in the next five years.

Responding to queries from Channel NewsAsia, PUB said the investment will be in water infrastructural projects such as NEWater network expansion and upgrading of NEWater plants.

Singapore already has five NEWater plants and the latest will be built at Changi by Sembcorp Utilities.

With the addition of this new plant, NEWater will meet a third of Singapore's current water needs by 2010.

Oil crosses US$135 in Asian trade



SINGAPORE - Oil smashed past US$135 a barrel for the first time Thursday, continuing its astonishing rise following unexpected drops in US crude and gasoline stocks in a tight market, dealers said.

Large institutional investors continued to pile money into oil, which is giving better returns than investments in stocks and bonds, further heating up prices, they said.

The Commonwealth Bank of Australia said in a market commentary that the "oil price also benefited from further US dollar weakness."

New York's main oil futures contract, light sweet crude for July delivery, briefly rose to a high of US$135.04 a barrel before easing to US$134.59 in Asian afternoon trade, up US$1.42 from its US close.

The benchmark futures contract had closed a whopping US$4.10 higher at a record US$133.17 on the New York Mercantile Exchange, and continued its upward spiral in after-hours electronic trade.

London's Brent crude contract for July was also busting records, rising to a high of US$134.50 before pulling back to trade at US$134.36, smashing its
intraday peak of US$133.34 set a day earlier.

In unadjusted terms, New York oil has risen more than fourfold compared with five years ago when it was trading at just below US$30 a barrel.

"Currently, market psychology is trumping fundamentals," said Victor Shum, an analyst with energy consultancy Purvin and Gertz in Singapore.

"The psychology is that the oil market is tight. Even though there is no shortage, global oil demand continues to grow and supply growth is restrained,"
he added.

"Oil has performed better than equities and bonds. There is money looking for better returns and oil has offered better returns and continues to offer better returns."

Oil's relentless rise appears to fulfil predictions from some analysts of a super-spike that could take oil to US$150 to US$200 a barrel and sent stock markets across Asia tumbling.

"The ghost of high oil prices will continue to stalk an already bearish market," said Astro del Castillo at First Grade Holdings in the Philippines.

Goldman Sachs analyst Arjun Murti added to the speculative fever earlier this month with a dire prediction of higher oil prices, citing "a lack of adequate supply growth" and still-strong demand.

"The possibility of 150-200 dollars per barrel seems increasingly likely over the next six to 24 months," he said in a research note.

With prices already on the rise, the US Department of Energy's weekly snapshot of energy inventories, which unexpectedly showed declines, added a further push, analysts said.

The DoE report Wednesday showed US crude oil stocks fell in the week ended May 16, by 5.4 million barrels to 320.4 million barrels. Most analysts had expected a build of 300,000.

Gasoline inventories dropped by 800,000 barrels, to 209.4 million, confounding expectations of a gain of 250,000 barrels.

The news was particularly market-sensitive, coming days ahead of the US summer-holiday driving season that kicks off this weekend for the Memorial Day holiday on Monday.

Americans have already begun buying less gasoline as prices at the pump hit new highs. The change in driving habits is raising concerns about a slowdown in consumer spending, the main engine of the world's biggest economy.

Shum of Purvin and Gertz said the high oil prices could prompt some people to cut down on fuel consumption, but added that demand would still pick up seasonally.

The rapid surge in oil prices came as the US Federal Reserve slashed its 2008 growth forecast for the US economy, the world's biggest oil consumer.

The Fed on Wednesday slashed its forecasts to a range of 0.3 to 1.2 percent, from its prior forecast of 1.3 to 2.0 percent in January. The central bank cited higher oil prices as a key factor weighing on momentum. - AFP/ir

Serial car thief nabbed  




SERIAL car thief was arrested in a police ambush on Wednesday morning.

The 36-year-old suspect, who is believed to be involved in a spate of thefts from vehicles in multi-storey carparks in Woodlands, Sembawang and Admiralty since March this year, was nabbed at the void deck of Block 802, Woodlands Street 81 at about 9.15 am.

Stolen items, including car keys, cashcards, EZ-link cards and bank cards, worth about $500, were seized from him.

The suspect is expected to be charged in court for theft on Thursday. If convicted, he faces a jail term of up to three years, or a fine, or both.

Hit-and-run accidents across Singapore leave 3 dead

TWO pre-dawn hit-and-run accidents yesterday - one along Jalan Buroh and the other on the Pan-Island Expressway (PIE) - left three men dead.

While the driver for one has not been traced, the other - a taxi driver - has since been arrested.

In the Jalan Buroh accident at 3.35am, the victims were two PUB employees working on a water pipe in front of their parked lorry.

The police said a prime mover slammed into the rear of their lorry, which then lurched forward and hit Mr Rahim bin Hamzah, 58, and Mr Bahari bin Treemon, 55.

The driver of the prime mover disappeared from the scene, leaving his vehicle behind.

Mr Rahim died at the scene, while Mr Bahari died in hospital two hours later, the police said.

PUB said the two men were higher technicians who had been with PUB for more than 35 years, and that the water agency would do its utmost to help their families.

In the other accident, which happened about half an hour before the Jalan Buroh one, a motorcyclist lost his life on being run over by a taxi on the Tuas-bound PIE.

The police said the taxi driver, who fled from the scene, was arrested about two hours later.

The motorcyclist, Mr Chow Kok Qong, 31, had been riding for nine years and had an accident-free record, said his brother Eric Chow.

The 39-year-old church worker was too much in shock over the news of his loss to say more.

He could only add: 'I really don't know what to say or how to feel about this because it all happened too fast and sudden...I need some time to absorb all this now.'

Man drowns when pleasure boat sinks off Marina South Pier


A 57-year-old man drowned when the boat he was in capsized while returning from Kusu Island at about 8.15pm on Thursday.

Eleven other members of his family were also on the boat.

Police said the boat encountered problems on its way to Loyang and sank about four nautical miles off Marina South Pier.

Eight passengers were rescued by the Coast Guard, while four others were picked up by two passing craft.

The man was pronounced dead at about 9.10pm. The rest were conveyed to the Singapore General Hospital.

ICJ awards Pedra Branca's sovereignty to Singapore

THE HAGUE: The International Court of Justice (ICJ) at The Hague in the Netherlands has awarded sovereignty of Pedra Branca island to Singapore, while the sovereignty of Middle Rocks has been awarded to Malaysia.

The world court delivered the judgment on Friday, after several rounds of written and oral pleadings by disputing countries Singapore and Malaysia. The ICJ last heard arguments from both sides in November 2007.

For Pedra Branca, ICJ's 16-member bench voted 12-4 in favour of Singapore.

Ownership of Middle Rocks, a maritime feature 0.6 nautical miles from Pedra Branca, was voted 15-1 to Malaysia.

The verdict brings to a close a 28-year row between the two neighbours. The dispute arose in 1980 when Singapore protested against a new Malaysian map of its maritime boundaries, which claimed the islet for itself.

Years of bilateral talks failed to resolve the matter and the parties agreed to seek the intervention of the UN court.

Pedra Branca, which Malaysia calls Pulau Batu Puteh, is located some 24 nautical miles to the east of Singapore and it commands the entire eastern approach to the Singapore Strait, through which almost 900 ships pass daily.

Pedra Branca also houses the Horsburgh Lighthouse, the oldest feature on the island which was built by the British between 1847 and 1851.

Leaders from both Singapore and Malaysia had said they would accept the ICJ's decision and stressed that whichever way it went, it would not affect bilateral ties.

SINGAPORE : Singapore's Prime Minister Lee Hsien Loong has said he is pleased with the judgement made by the International Court of Justice (ICJ) on Pedra Branca.

He said Singapore fully accepts the ruling and he is glad that Malaysia has also consistently said that it will accept ICJ's judgement.

Mr Lee said this is a good way to resolve disagreements or problems while maintaining good relations with each other.

He added that Pedra Branca has been a longstanding issue between Malaysia and Singapore.

Former Prime Ministers Mahathir Mohamad and Goh Chok Tong had agreed to send the dispute for adjudication at the ICJ in September 1994 and to abide by the ICJ's ruling.

He remembered that when he visited Malaysia in 1995 and spoke at INTAN, their Institute of Public Administration, Abdullah Badawi - who was then Foreign Minister - chaired a talk.

PM Lee recounted, "I was asked whether if the ICJ awarded Pedra Branca to Malaysia, Singapore would accept the judgment. I replied immediately 'yes of course', and PM Abdullah chipped in to assure the audience that naturally Malaysia would also do so if the judgment went the other way."

PM Lee is glad that this problem is now cleared.

He will be writing to Prime Minister Abdullah to express his thanks to him that both countries have been able to work together to resolve this problem "and we can now go on to develop our cooperation in many areas, such as the Iskandar Malaysia project."

He said he would especially like to thank the Singapore team at The Hague.

PM Lee said, "They did a magnificent job in preparing and presenting Singapore's case before the ICJ. Deputy Prime Minister S Jayakumar, Ambassador Tommy Koh, Chief Justice Chan Sek Keong, our foreign counsel, and many officials from our ministries and agencies have worked very hard on this case for a long time - in Professor Jayakumar's case, for 29 years. On behalf of Singaporeans, I thank all of them for their contributions and efforts." - CNA/ms
