Customs Seizes Drugs Sold Without Permit
Bandar Seri Begawan - Pharmaceutical drugs sold without a permit, including a slimming capsule that was banned by Brunei's Ministry of Health last December, were seized by officials from the Royal Customs and Excise Department following a tip-off from members of the public.
A 59-year-old woman has been summoned to the Preventive and Intelligence Section, Royal Customs and Excise Department to assist in the investigations pertaining to the seizure of drugs estimated to be worth RM 10,790.
Eleven officers from Preventive and Intelligence Section, as men as two officers from the Pharmaceutical Unit, .Ministry of Health inspected the shop in the capital Monday on complaints that it was selling pharmaceutical drugs without a permit from the ministry.
During the inspection, authorities confiscated 15 boxes of Amberine Capsules, 30 boxes SNE Capsules, one box of Kintop Capsules and nine boxes of Exel Tea. The items were seized under the notice of Customs seizure and the offender can be charged under chapter 140 of the Customs Order 2006.
Among the items that were confiscated was slimming capsule Kintop that was banned in December last year by the Ministry of Health. The capsules were found to contain Sibutramine.
Sibutramine is a slimming agent and long term consumption of the capsule may lead to high blood pressure, heart palpitation and insomnia, a press release from the ministry had stated. This substance cannot be used by individuals with a history of cerebrovascular disease or cardiovascular disorders such as cardiac arrythmias, heart failure, peripheral arterial occlusive disease, coronary and artery disease, it added.
It should also be avoided by individuals suffering from severe hepatic or renal impairment, the ministry had warned.
The Bulletin had reported on the banned pharmaceutical drug last February when it was found in the Brunei market. Malaysia's News Strait Times had reported that a 33year-old housewife, from Alor Setar, died from blood poisoning and kidney complications and her husband claimed that she took Kintop capsules.
According to reliable sources, Kintop capsules were sold in the market for $116. Further enquiries revealed that even though people knew of the dangers, they continued to use the capsules.
Under the Poisons Act (Chapter 114) it is an offence to import, sell or offer for sale any product containing a poison without prior licence issued by the Ministry of Health.
It is also an offence under the Poisons Act 1956 to sell any product containing any substance controlled under the Poisons Act and the penalty for such an offence, upon conviction is a fine of $8,000 or six months' jail.
The Preventive and Intelligence Section of the Royal Customs and Excise thanked the public for the information and urged those with knowledge on such activities to call their hotline number 2382422 or SMS to 8714422.-- Courtesy of Borneo Bulletin |

Steel-Laden Trailer Stranded In Jalan Kiarong
Bandar Seri Begawan - A Heavy load caused a trailer to accidentally slide backwards as the vehicle attempted to go up a hilly road yesterday.
Police blocked the road temporarily to allow workers using a crane to free the trailer and remove the load from the vehicle.
The trailer laden with about 30 tonnes of steel was going up a hilly section of Jalan Kiarong when it suddenly slid backwards due to the heavy load.
"I quickly steered the truck to the left side of the road to avoid a collision as there were many cars on the road at the time," said the trailer driver.
Personnel from the BSB Police Station received a call on the incident at 3.10pm yesterday and arrived at the scene within five minutes. The incident is under investigation.-- Courtesy of Borneo Bulletin |

Trafficking Laws In Brunei Stringent
By Amin Hosni
Bandar Seri Begawan - The Brunei Government's effort in training its enforcement officers in tackling human trafficking has been highlighted in the 2007 Trafficking in Human Report issued by the US State Department.
The report also considers the nation's human trafficking laws as sufficiently stringent.
For the second consecutive year, Brunei remains a special case in the report as it cites insufficient data that makes it unknown whether there are a significant number of victims in the country.
The large number of legal migrant workers in Brunei facing conditions of involuntary services raises concern that there may be a significant number of trafficking victims, the report says.
A large number of men and women from Southeast Asia come to Brunei Darussalam in search of domestic or low-skilled work.
According to the report, an unknown number of the migrants may be subject to conditions of involuntary servitude after arrival. Victims may suffer conditions including non-payment of wages, confinement to the home and contract switching. Brunei has a small trafficking challenge in part due to its small size and vigorous enforcement.
The report also praises Brunei government's strong enforcement of immigration and labour codes.
"The government over the years has demonstrated efforts to fight trafficking in humans," the report says. However, it relies on mostly administrative and not criminal penalties, it added.
Justin Friedman, Charge D'Affaires, of the US Embassy when asked about the report yesterday said that Brunei's Trafficking and Smuggling Persons Order is very strong.
Commenting further on Brunei's law, he noted that the strong provisions (in these laws) largely meets the international understanding on human trafficking and smuggling.
Highlighting the country's Trafficking and Smuggling Persons Order of 2004, the latest report says that there have never been any prosecutions under this order.
Labour cases, usually non-payment of wages and contract switching are usually tried under Brunei's Labour Act. Penalties for commercial sexual exploitation are equivalent to those of rape cases.
The penalty of labour trafficking according to the Labour Act is three years' imprisonment while the 2004 Trafficking and Smuggling Order prescribe sentences up to 30 years' imprisonment, which is sufficiently stringent.
The Enforcement Section of the Department of Labour has recorded 72 complaints by domestic helpers and 288 complaints by corporate and garment workers against employers who failed to pay salaries, says the report.
A majority of these complaints were resolved through mediation. The local media has published reports of Brunei employers receiving administrative penalties for failures to pay wages. It's unclear if these cases were investigated as trafficking cases. To date, there have been no reports of government or law enforcement complicity in trafficking, the report adds.
Brunei's Government has made some efforts to protect trafficking victims by offering shelter and other services for foreign victims when identified.
The 2007 report also states that there are no foreign NGOs or international organisations in Brunei to provide victim support. Filling the gap is the embassies of several labour source countries that have come forward to provide shelter, mediation, and immigration support to their nationals.
The government also encourages victims to assist in investigations as witnesses. In one case, the victim refused to participate in a trafficking investigation even when the government encouraged, the report adds.
Under Brunei's anti-trafficking order, the government may provide temporary residence and work permits to persons identified as trafficking victims.
Police and prosecutors have an on-going programme to improve their skills in identifying victims of trafficking, says the report.-- Courtesy of Borneo Bulletin |

Slippery Road Conditions Led To Tragic Accident
Kuching - Slippery road conditions caused by rain contributed to the accident in which five family members from Brunei were killed when their car caught fire after colliding with a bus in Sibu Tuesday.
Sarawak Deputy Police Commissioner SAC I Datuk Abdul Rahman Hussin said initial investigations showed that the slippery road caused the driver of the car to lose control of the vehicle.
"The bodies are now at the Sibu Hospital and we'll coordinate the arrangement to send their remains back to Brunei," he said yesterday.
The victims were identified as Gazali Yahya from Kg Rimba, his wife Zulyana Hassan and their children Fatin Nabillah, 12, Fatin Khairuniza, 10, and Mohd Ali Amri, six.
They were killed instantly in the crash at Km38 Jalan Oya, Sibu at about 3.45pm.
The car Gazali was driving collided with the Universiti Teknologi Mara bus and caught fire killing instantly all the five inside the car. The bus driver and 15 passengers escaped unhurt.-- Courtesy of Borneo Bulletin |
