17 Lelaki Rusuh Di Kuil Sri Maha Mariamman Seafield Dibebaskan Tanpa Bela Diri

17 lelaki yang didakwa merusuh di Kuil Sri Maha Mariamman Seafield, Subang Jaya pada 2018, dibebaskan Mahkamah Majistret Petaling Jaya hari ini tanpa dipanggil membela diri.
Majistret Muhammad Iskandar Zainol memutuskan pihak pendakwaan gagal membuktikan kes prima facie di akhir kes pendakwaan.

Menerusi penghakimannya, Iskandar berkata, tiada pengenalpastian positif tertuduh termasuk melalui pengecaman di kandang tertuduh.
"Tiada senjata dikemukakan di mahkamah sebagai bahan eksibit seperti pisau seperti yang dinyatakan dalam kertas tuduhan," katanya, hari ini.
Peguam R Kirthiraj yang mewakili salah seorang tertuduh, Saifullah Abdullah mengesahkan perkara itu ketika dihubungi.
Tertuduh lain ialah Riduan Sekh Ruslan, Irwan Noordin, Khairi Abdul Rashid, Rozaihan Zakaria, Qayyum Mohd Faisal, Ashraf Mohd Faizal, Absal Eastrie Abdullah, Jalil Talib, Khairol Anuar Zabidi, Zamri Md Said, Shukri Razali, Nor Azmi Abdul Ghani, Shahril Danniel Sajeel, Hasneezam Shah Samsudin, Akmal Izzat Azi dan Norul Ismawi Islahuddin.
Kirthiraj berkata, mahkamah memutuskan saksi pendakwaan gagal mengenal pasti tertuduh berikutan kejadian awal pagi itu.
"Mahkamah juga mendapati saksi itu tidak boleh dipercayai kerana tidak konsisten kenyataan mereka di mahkamah.
" ihak pendakwaan juga tidak mengemukakan sebarang senjata di mahkamah sebagai eksibit seperti pisau seperti yang dinyatakan dalam kertas pertuduhan.
"Semua senjata itu hanya dikutip dari tempat kejadian oleh saksi dan bukannya rampasan daripada tertuduh," katanya.
Beliau berkata, pihak pendakwaan juga tidak mengemukakan sebarang laporan forensik senjata itu.
Kesemua tertuduh berusia antara 24 dan 47 tahun didakwa merusuh dan memiliki senjata berbahaya antara 2 pagi hingga 5 pagi pada 26 November 2018.
Mereka didakwa mengikut Seksyen 148 Kanun Keseksaan yang memperuntukkan hukuman penjara maksimum lima tahun atau denda atau kedua-duanya sekali jika sabit kesalahan.
Rusuhan itu yang berlaku pada awal pagi 26 November 2018 apabila sekumpulan lelaki memasuki kuil.
Pergaduhan itu dikatakan berpunca daripada isu penempatan semula kuil, dengan beberapa penganut enggan berbuat demikian.
Rusuhan itu menyebabkan puluhan kenderaan dibakar dan beberapa orang cedera.
Kira-kira 24 jam kemudian, lebih banyak kenderaan dibakar dan pasukan Jabatan Bomba dan Penyelamat yang bertindak balas terhadap panggilan kecemasan diserang.
Kejadian itu turut meragut nyawa seorang anggota bomba, Muhammad Adib Mohd Kassim, yang cedera di tempat kejadian sebelum meninggal dunia sebulan kemudian di Institut Jantung Negara.
Pada 2019, mahkamah koroner memutuskan kematian Adib berpunca daripada perbuatan jenayah membabitkan dua atau lebih individu tidak dikenali.
