We were not paid, say ex-employees of True Fitness Malaysia (Updated)
PETALING JAYA: The sudden closure of a popular fitness centre here has left its employees in the lurch with many planning to lodge reports with the industrial relations department.
Several employees of True Fitness Malaysia today said they were not paid their salary since the beginning of the year.
"We hope to get what we deserve, which is our salary," said David Thoong, a former group exercise manager of the fitness chain's local operations.
"We have worked hard for the company. Days, weeks or even months of hard work but at the end of the day, they have not paid us a total of over four months' salary.
"We want this to be known locally and internationally, whereby to let people know how horrible they are in robbing their own employees' salary while expanding their branches in Singapore and China."
Thoong said he had not been paid since February. "Altogether, True Fitness owes me about RM10,000," he was reported as saying in a Facebook posting.
He resigned from the company in May after not receiving his pay for four months. He joined True Fitness last August.
In the posting, he said his official last day of service in True Fitness was June 7.
Thoong alleged that he got rude replies from the management when he inquired about his unpaid salary.
Another former employee, Ahmad Kamil, said he had not been paid since last January. "All together, it is close to RM15,000. I have a family to feed. How am I going to support my family?"
"I lodged a complaint the second month I did not receive my pay. I do not know about the other ex-employees. I hope they do the same, too. Every month, there were always at least a couple of people leaving the company. Now I know why," he was quoted as saying.
Another former employee Wan Fariza Wan Muhamad Zin said the director did not show up for work since last month.
"We had no direct face time with her at the office after that. Then, our office was abruptly shut down on June 10," she said. "I'm now into my sixth month of pregnancy. In my present condition, it is hard to get another job."
Attempts to reach the management today did not yield any response.
True Fitness Malaysia is a Singapore company and it had announced the closure of all its gym and spa facilities in Malaysia on its website on Saturday after having ceased operation in Thailand on Friday.
"The past few years have proved challenging, and unfortunately, the businesses are no longer financially viable due to evolving market conditions," True Fitness said in a statement on the site on Saturday.
Meanwhile another fitness centre, Chi Fitness has denied there was an agreement to transfer membership from True Fitness to it.
"In light of the recent True Fitness closure, we would like to clarify that we have no contract or arrangement to honour or takeover any commitment from True Fitness," CHi Fitness posted on their Facebook page today.
CHi Fitness said that it was approached by True Fitness to purchase 2,000 monthly passes to CHi gyms in Klang Valley (except Nexus and Bangsar Shopping Center branches) to be passed on to their members, but the sale has not been finalised.
"They have asked to purchase RM20,000 worth of one-month membership vouchers from us.
"There is RM20,000 (worth of vouchers) available and we have agreed to honour them over the period of two years," she said, adding that RM20,000 was an "arbitrary term" used during discussions," Ashley Paulus, CHi Fitness operation director was quoted as saying in local media. |

True Fitness members rallying to file legal action before company winds up
PETALING JAYA: True Fitness Malaysia members are rallying to seek legal redress before it is too late to receive compensation due to the gym chain's abrupt closure.
In some cases, banks are continuing to charge the monthly credit card instalments for membership packages.
Members see an urgent need to commence legal action before the Singapore-based company is wound up here.
A day after the fitness and wellness chain announced its closure in Malaysia on June 9, the "True Fitness Complaints" Facebook group was set up for "victims", including paying members and the chain's staff, to air grievances and discuss their plan of action.
Leading efforts to demand a refund is accountant Vincent Goh, 52, who is urging the community to file a police report against True Fitness Malaysia and demand that the banks stop imposing monthly instalments for membership packages.
Goh still has seven months left to pay on a 12-month instalment plan taken for a three-year membership package costing RM3315.05.
He said banks typically respond that they will not do anything until the completion of their own investigations, which can take 45 days.
"Their standard reply is 'that is between you and the vendor and we have already paid the vendor'," he said.
"Some life memberships cost RM8,000 to RM9,000 while those who have VVIP memberships pay much more, " he said.
Goh is also compiling a list of all affected members, which he will use to file a complaint with his assemblyman, the Malaysian Consumers Association and the Domestic Trade, Co-operatives, and Consumerism Ministry.
Assisting Goh with the database of affected members is a software engineer who only wanted to be known as Chew.
Chew, 26, said she was surprised to learn that the company had been recruiting new members days before its closure.
"Some signed up for new packages on June 9, a day before the announcement," she said.
Two lawyers and long-time True Fitness Malaysia members Chen Yu Szen and Alex Netto are contemplating a class-action suit against the company and are volunteering their legal services for free.
However, legal recourse may be complicated as the holding company True Group is based in Singapore and has multiple subsidiaries in Malaysia including True Fitness Sdn Bhd, True Yoga Sdn Bhd, Fitness World Sdn Bhd and Fitness Growth Sdn Bhd.
Chen highlights that action needs to be taken quickly as it will be difficult to demand compensation if the company is wound up.
"That would mean it would be harder for the creditors to enforce the company's debts," the 27-year-old lawyer said.
Chen claims True Fitness Malaysia's actions "reeks of fraud" as there is a clause in the contract stating that the management must provide a 30-day closure notice.
On top of that, Chen said some members who visit the gym regularly have left valuables in their gym lockers with no way of retrieving them.
True Fitness Malaysia and Thailand's surprise closures come a week after True Group, announced aggressive expansion plans in China.
The announcement said it has ceased all operations of its gyms and spa facilities here as it was "no longer financially viable" due to evolving market conditions.
The company said they will not refund customers with new or existing memberships, and that arrangements have been made with CHi Fitness to serve as an alternate gym for affected customers.
CHi Fitness has denied that there is an agreement with True Fitness Malaysia to honour membership transfers to their gym centres for its members.

Ex-staff claim owed RM66,000 in True Fitness commissions
PETALING JAYA, June 13 ― Former employees have accused the True Fitness gym chain of failing to pay RM66,000 in commissions before it wound up its operations in Malaysia.
After lodging reports with the Labour Department here, former fitness manager Shahrul Hamiri Shahruddin revealed that commissions of over RM27,000 were owed to seven employees from the Sunway Giza branch.
A document sighted by Malay Mail Online showed RM22,104 was owed to six staff members from the Jaya33 branch, and RM16,488 to five employees from the Subang Jaya branch.
“We have gotten our salaries for last month. We just want to fight for our commissions and also a compensation for being retrenched without notice,” Shahrul said to reporters when met at the Labour Office.
