I rase loopholes dekat sini mksd penetration should be changed..penetration should not only by penis..what is the diff btwn penis,cucumber,finger jika apa yg dibuat sentuh n masukkn something dlm private part wout consent? |

Pasal sex dgn minor tu tak dpt dibuktikan sbb tak de pendaftaran masuk hotel tu kan mik? Jadi tak ...
Acc to the law 15 years not longer cons statutory rape..kalau ada element consent dr tht girl..it considered free will seks..

376(2)(d) -so if there is consent it is no longer a rape..
The act of the child of 15 yrs of age following the accused to the hotel..considered a consent..so rape is not occured..

It is very sad truth..aku xsangka agc boleh bt sebegini..
Yg ahli parlimen lain tu bkn pnh dgr pun masa amndmnt ni dibuat..kalau xtdo..xhadir..ce tny maslan..confirm xtau amndmnt ni..huhu..
Teringin bc yg verdict bersalah tu..hi ct judge interpret cmne..kdg2 hi ct judge aku rasa lg wise then appelate ct judge..hihi..

Tp from my personal point of view the judge no careful in deciding whats constitute a consent from girl wth tht year of age..
What amount to consent should be scrutinized further espcially at tht tender age..did she know what is actually she been doing with tht bunya?i think ct sepatutnya go further on this dr rely on the fact xde tulis nm dkt register book n the fact the girl bluntly follow bunya without any coercion..
And also in the fact what amount to penetration..the judge also not scrutinize enough to discuss further what amount to penetration tp cuma ambil safe side to decide penetration must only by penis..
Tp what has already done is done..tunggu shj mhkmh akhirat nnt.. |
