Ambil Tindakan Jika Rakam, Sebar Polis Buat Serbuan

Mereka yang merakam video atau membuat siaran secara langsung (live) ketika anggota polis melakukan serbuan atau tangkapan boleh diambil tindakan kerana ia dianggap menghalang penjawat awam menjalankan tugas serta boleh mengganggu siasatan.
Pengarah Jabatan Siasatan Jenayah (JSJ) Bukit Aman, Datuk Huzir Mohamed, berkata tindakan mengambil gambar atau merakam video bukan satu kesalahan jenayah, namun bukan ketika anggota polis sedang menjalankan siasatan terhadap sesuatu kes.
"Tindakan merakam gambar atau video bukan satu kesalahan jenayah.
"Bagaimanapun, sekiranya gambar atau video itu dikongsi, disebar dan ditularkan di media sosial atau dalam apa sahaja cara, ia boleh mengganggu siasatan polis.
"Ia juga bertentangan dengan peruntukan mengikut Seksyen 233 Akta Komunikasi dan Multimedia 1998 yang memulakan penghantaran dengan niat mengganggu orang lain," katanya dalam satu kenyataan, hari ini.

Beliau berkata demikian bagi mengulas tangkapan ke atas seorang lelaki kerana mengganggu dan menghalang tugas polis ketika membuat serbuan di sebuah rumah di Jalan 17/48, Petaling Jaya, Selangor Ahad lalu.
Polis membuat serbuan di rumah berkenaan berhubung siasatan satu kes bersabit Seksyen 4(1) Akta Hasutan 1948.
"Sebelum penggeledahan dibuat, pegawai serbuan yang memakai rompi Polis menunjukkan kad kuasa kepada seorang lelaki yang berada di rumah namun dia enggan memberi kerjasama dengan mengunci pintu dari dalam," katanya.
Katanya lagi, seorang wanita mengaku sebagai peguam dan seorang lelaki kemudian hadir ke lokasi sebelum lelaki berkenaan membuat siaran video secara langsung melalui Facebook Live (FB Live) menggunakan telefon bimbitnya.
"egawai serbuan sudah beberapa kali memberi amaran supaya dia menghentikan tindakannya namun lelaki itu tetap meneruskan rakaman.
"Susulan itu, lelaki 23 tahun itu ditangkap kerana mengganggu proses siasatan serta menghalang penjawat awam melakukan tugas selain telefon bimbit serta kad sim yang digunakannya turut dirampas," kata Huzir.
Menurut beliau, tangkapan dibuat kerana kesalahan mengikut Seksyen 186 Kanun Keseksaan iaitu menghalang penjawat awam menjalankan fungsi jawatan dan tangkapan itu berlandaskan undang-undang demi kepentingan siasatan.
Beliau turut menegaskan setiap siasatan adalah sulit dan tidak boleh didedahkan sewenang-wenangnya, apatah lagi ditularkan di media sosial.
Sebelum ini, media melaporkan polis menjalankan siasatan terhadap Presiden Persatuan Belia Baharu Universiti Malaya (UMANY), Yap Wen Qing mengikut Akta Hasutan 1948 berhubung kenyataan kontroversi mengenai peranan Yang di-Pertuan Agong, Al-Sultan Abdullah Ri' ayatuddin Al-Mustafa Billah Shah.
Mengulas lanjut perkara itu, Huzir mengesahkan polis sedang menjalankan siasatan berhubung kenyataan yang dimuat naik di laman FB 'University of Malaya Associaton of New Youth (UMANY) bertajuk 'YDPA Sholud Not Intefere in National Affair' itu.
"Siasatan dijalankan mengikut Seksyen 4(1) Akta Hasutan 1948 dan Seksyen 233 Akta Komunikasi dan Multimedia 1998," katanya.
Dalam pada itu, media turut melaporkan seorang aktivis pelajar, Wong Yan Ke ditahan ketika membuat siaran secara langsung ketika polis menyerbu kediaman Wen Qing, di Petaling Jaya, Ahad lalu.
Tangkapan ke atasnya kemudian ditularkan oleh pihak tertentu di media sosial dan mengundang pelbagai reaksi dalam kalangan netizen.

KUALA LUMPUR, Nov 10 — DAP MP Ramkarpal Singh today questioned the claim that recording a video of police investigations could be considered an offence for the alleged obstruction of duties by government officials, saying that it should be up to the courts instead to decide whether such actions are legal.
Ramkarpal, who is also chairman of DAP’s national legal bureau, said it was “blatantly wrong” to suggest that taking a photograph or recording a video of police carrying out an investigation would be an offence under Section 186 of the Penal Code, noting that such an idea gives the impression that the police are afraid of being watched while carrying out investigations.
Ramkarpal highlighted Section 186, which states that anyone who “voluntarily obstructs any public servant in the discharge of his public functions” shall be punished with a maximum two-year jail term or a maximum RM10,000 fine or both.
The phrase ‘voluntarily obstructs’ is unambiguous and refers only to situations where one actively does something that hinders a police officer from carrying out his duties.
How does a passive act of recording investigations come within the ambit of section 186?” the Bukit Gelugor MP said in a statement today.
Ramkarpal said it should be left to the courts to decide if the act of recording police investigations is illegal after considering all the relevant evidence, and that it is not for the police to say whether such actions are illegal.
“Even the inspector-general of police has mooted the idea of body cameras on police officers in the past, obviously for the purpose of promoting transparency in the investigation process,” he said.
Ramkarpal then questioned if the police are suggesting that body cameras were also illegal, saying that this would by extension lead to the “absurd” idea that recordings captured by close circuit television (CCTV) cameras of police officers carrying out investigations would also be illegal.
“There is nothing wrong with recording a police officer carrying out his duties as long as this is done without obstructing him. In fact, this should be encouraged to promote transparency of the investigation process,” he said.
Ramkarpal said the police should stop making blanket statements and leave it to the courts to decide if a particular situation involving the recording of police officers is illegal, based on evidence.
Ramkarpal was referring to the statement made by Bukit Aman criminal investigation department chief CP Datuk Huzir Mohamed earlier today.
