Tony Pua asks UK authority to seek explanation on 1MDB’s ‘missing payment’ to UAE firm

DAP lawmaker Tony Pua has sent a letter to the United Kingdom Listing Authority (UKLA) requesting it to seek a clarification from International Petroleum Investment Corporation (IPIC) on the US$1.4 billion (RM6 billion), which is allegedly missing from its financial statements, as reported by The Wall Street Journal (WSJ) recently.
Pua, who is one of the chief critics of the troubled 1Malaysia Development Berhad (1MDB), said he had decided to write the letter as it did not seem like the state investment fund was concerned about the missing money.
"I have decided to write the letter because it appears that the financially distressed 1MDB is not at all concerned that its US$1.4 billion pledged as collateral with IPIC in exchange for a US$3.5 billion guarantee, is reportedly 'missing'," Pua said in a statement today.
"This matter was exposed by the WSJ last week but was met with disdain from 1MDB.
“The company was more interested in victimising the mystery whistleblowers than discovering the truth behind its funds."
Pua, who is also Petaling Jaya Utara MP, said that he had expressed the concern of Malaysians over the missing funds, which belonged to 1MDB, a wholly-owned Finance Ministry subsidiary.
"I explained to UKLA that the financial statements of 1MDB audited by Deloitte Malaysia stated clearly that the company placed US$1.4 billion of funds with IPIC as a 'refundable deposit'. It is classified as a non-current asset, under 'other receivables, deposits and prepayments'.
"However, when scrutinising the listing prospectus of IPIC bonds, which was listed in the London Stock Exchange in December 2014, the US$1.4 billion did not appear anywhere in the published accounts of the company.
Neither was the sum disclosed in the December 2014 audited accounts of IPIC published on June 30, 2014."
Although IPIC did reveal that they had provided a guarantee for the US$3.5 billion of bonds raised by 1MDB in 2012, it did not make any mention in any documents that they had received the collateral of US$1.4 billion, Pua said.
"It is important for IPIC to make a public disclosure with regards to the above to provide 1MDB and its stakeholders the assurance that our interests are fully protected.
"We hope that UKLA will give due consideration to our request for clarification and we look forward to IPIC providing a full public disclosure to be published on the website of London Stock Exchange."
Last week, WSJ quoted sources saying that a US$1.4 billion payment from 1MDB was missing from IPIC's financial statements.
IPIC had guaranteed the US$3.5 billion in bonds that 1MDB issued to finance the purchase of power plants in 2012. In return, IPIC had the option to buy a 49% stake in the power plants as well as collateral for the bond.
According to the auditor-general’s draft report, 1MDB made a collateral payment of US$1.4 billion, which went to Aabar Investments PJS, a subsidiary of IPIC, said WSJ in its report highlighting the missing money.
IPIC’s consolidated financial statements, however, show no reference to the receipt of the payment. Quoting sources, WSJ said neither IPIC nor Aabar received the money and they had no knowledge of the its whereabouts.
In refuting the report, 1MDB said that its audited financial statements "clearly describe" the amount and purpose of the payments, which, it added, was structured as a deposit (i.e., a financial asset belonging to 1MDB and not an expense to 1MDB). – September 16, 2015.
